  • Represent CAMH and its clinicians in proceedings before the Ontario Review Board, Consent and Capacity Board, Health Professions Appeal and Review Board, the Human Rights Tribunal of Ontario, regulatory health colleges, and resulting appeals at all levels of court
  • Provide hearing-related support and consultation to CAMH clinicians who are self-representing at hearings
  • Provide strategic and contextual legal advice to clinicians and clinical leadership on a wide range of clinical legal issues
  • Proactively identify and assess legal and risk issues in relation to clinical activities, projects and partnerships in furtherance of CAMH’s strategic plan
  • Provide support to internal stakeholders who co-support clinical operations (including Health Records, Privacy, Risk, Patient and Family Experience Office, Quality and Patient Safety, Professional Practice Office, Medical Affairs, Ethics)
  • Engage and foster collaborative relationships with external partners (legal counsel, court and tribunal staff, local police, corrections personnel)
  • Provide legal advice in the development and review of internal policy, procedures and guidelines to support compliance with applicable law.
  • Develop and implement legal education, training and resource material for clinicians to support their provision of care in a complex legal environment
  • Represent CAMH at external events (conferences, courses, symposiums, meetings), where appropriate
  • Provide leadership to the mental health sector through knowledge exchange, strategic engagement systemic advocacy, and the delivery of education/training/consultation outside of CAMH
  • Monitor legal developments, issues and trends across the clinical legal sector, and translate into input and insight toward the development of organizational strategy and direction
  • Provide mentorship and supervision to law students
  • Participate in the development of resources, tools, templates, and precedents that enable efficient legal service delivery

The successful candidate is a member in good standing of the Law Society of Ontario, with a minimum of 5 years of legal work experience.

  • Experience with civil mental health law (application of the Mental Health Act, Health Care Consent Act, Substitute Decisions Act), and/or forensic mental health law (Mental Health Act, Criminal Code) is essential
  • Litigation experience before administrative tribunals (Ontario Review Board, Consent and Capacity Board, health regulatory Colleges, and/or the Ontario Human Rights Tribunal) and/or courts is essential
  • Appellate advocacy experience is an asset
  • Experience in health law (health privacy, regulatory health law, application of hospital-specific statutes) is preferred
  • Experience working within a public hospital or comparable large, complex public sector institution is desirable
  • Strong legal research and analysis skills, with sound judgment and the ability to provide practical and strategic legal advice tailored to the in-house environment
  • Ability to work collaboratively with diverse internal and external stakeholders
  • Attention to detail and the ability to navigate complex legal and ethical issues.
  • Highly developed communication, negotiation and advocacy skills, both oral and written
  • Strong interpersonal skills, including sound judgement, tact and diplomacy
  • Demonstrated understanding of how to apply principles of equity, diversity and inclusivity in day-to-day carriage of legal files.
  • Excellent organizational, planning and time management skills, with the ability to multi-task, prioritize according to urgency, and meet tight deadlines.

Demonstrated ability to collaborate and work on a team that includes legal support staff and law students. CAMH’s Legal Services team supports a healthy workplace that embraces diversity, encourages teamwork and complies with all applicable standards and requirements. This position is located at 101 Stokes Street, Toronto. On-site presence is required at a minimum of 3 days per week, with additional on-site presence required from time to time, to accommodate hearing schedules.

Compensation & Benefits:

  • Salary is competitive and based on experience, with a hiring range of$123,182.72 – $153,978.40 per year.
  • Employees in this role may progress within the full pay range of$123,182.72 – $184,774.08 per year
